Code Description:
The construction, use, maintenance or continued existence of illicit connections to the MS4 or any conveyance is prohibited. This prohibition expressly includes, without limitation, illicit connections made in the past, regardless of whether the connection was permissible under law or practices applicable or prevailing at the time of connection. A person is considered to be in violation of this Section if the person connects a line conveying sewage or any other pollutant or hazardous materials to the MS4 or any conveyance or allows such a connection to continue. The lift station for the property has failed again. The pump is inoperable and a plastic line was laid from the holding tank to the adjacent property in an apparent attempt to drain the tank. Potential seepage was noted on the slope. A licensed plumber must bring the system into compliance to eliminate any further illicit discharges by Friday, August 14 2026. This includes having a septic service pump out the tank on Monday, 3 August 2026, installing a bypass pump on Tuesday August 4 2026, leak testing the tank, and installing a new system (plumbing and electrical) to eliminate any further discharge by Friday, 14 August 2026. If any of the timelines above are not met, then additional enforcement actions will be taken, up to and including condemnation of the property as a danger to human and environmental health.
