Code Description:
Permits are required to be obtained from the City for all site construction projects and/or land disturbances as set out in the City of Bowling Green Stormwater Best Management Practices (BMP) Manual. The developer shall also coordinate with the KYDOW and the U.S. Army Corps of Engineers to determine whether permits are required from those agencies before construction begins. Each developer shall submit an application to the City on a form provided by the City. Due to the lack of response to prior correspondence, failure to remediate the neighboring lots as previously discussed, and the absence of required permits for the use of adjacent properties for construction traffic and material storage, a citation is being issued for the property located at 1571 Cabell Dr.
Additionally, it has been observed that mud is being tracked onto the roadway without the installation of an approved construction entrance, which is a violation of applicable regulations.
A follow-up inspection is scheduled for April 16, 2026, to assess compliance with the City of Bowling Green Chapter 21 Codes.
Following our phone conversation on March 17, 2026, you indicated your intention to maintain communication and complete the necessary cleanup within a couple of weeks. However, the initial outreach regarding these concerns began on January 8, 2026, and it has now been approximately four months without resolution.
While a final inspection has been issued for the home and there is an approved permit for the pool installation, proper procedures have not been followed to obtain authorization for the use of neighboring properties during construction.
Please address these violations promptly to avoid further enforcement action.

BGKY C21 21.2.04.j Failure to properly implement required BMPs Public Infrastructure, Rights-of-Way and Stormwater / Stormwater Quality / Illicit Discharge; Applicability; Responsibility
Code Description:
Requirement to prevent, control and reduce stormwater pollutants by the use of BMPs. The City shall review and approve BMPs for any activity, operation or facility that may cause or contribute to pollution, discharge of hazardous materials or has the potential to contaminate naturally occurring stormwater or waters of the United States. The owner or operator of a commercial or industrial establishment shall provide, at their own expense, reasonable protection from accidental discharge of prohibited materials or other wastes into the MS4 or any conveyance through the use of these structural and non-structural BMPs. Further, any person responsible for a property or premise which is, or may be, the source of an illicit discharge may be required to implement, at such person's expense, additional structural and nonstructural BMPs to prevent the further discharge of pollutants or hazardous materials to the MS4 or any conveyance. These BMPs shall be part of a Stormwater Pollution Prevention Plan (SWPPP) as necessary for compliance with requirements of the NPDES permit. Code Description:
Any proposed development meeting requirements as set forth in the City of Bowling Green Code of Ordinances, Zoning Ordinance and Subdivision Regulations must obtain permit approvals and pay fees as described in same. All conditions of approval shall be considered an integral part of the approved plans and shall be met.
