Code Description:
Other than naturally-occurring stormwater, no person shall discharge or cause to be discharged into the MS4, or any conveyance, any materials, including but not limited to pollutants or hazardous materials or waters containing any pollutants or hazardous materials that cause or contribute to a violation of applicable water quality standards. Allowable discharges that create or have the potential to create unsafe conditions on city streets or other public rights-of-way are prohibited. The commencement, conduct or continuance of any illegal discharge to the MS4 or any conveyance is prohibited. - On 15-Dec-25 a BGPW inspector observed the private lift station serving the 16 apartment units at 1964 Stonehenge Ave had failed and raw sewage was overflowing from the lift station. The pump was not running, and it appears that all of the sewage generated by the property was being discharged out of the lift station across the property. Code Compliance staff were contacted to assist. BGPW and Code Compliance staff gave the property owner 24 hours to stop the sewage discharge, and apply remedial measures to the area affected by sewage discharge. The property owner was
On 16-Dec-25, BGPW and Code Compliance staff re-inspected the site. The sewage discharge had ceased, but the sewage that had already been discharged was not addressed. BGPW engaged a contractor to apply hydrated lime to the discharged sewage at that time.
On 23-Dec-25, a follow-up inspection found that sewage discharge had resumed. The pump was not running, and the full discharge of the complex was again running across the ground before entering the state-owned property to the east and sinking into the ground. BGPW staff contacted Code Compliance and the Barren River District Health Department to assist. The property owner was given 24 hours to stop the sewage discharge, have the lift station repaired or updated to prevent future discharges, and remediate with lime. A plumber working for the property owner told a BGPW inspector at 21:30 that night that he had manually engaged the pump, which was not engaging automatically as it should, and drained the we well into the sanitary sewer. A service call was scheduled for the next day.
On 24-Dec-25, a re-inspection found sewage actively discharging. BGPW brought in a contractor to set up a bypass to abate the discharge.
By 02-Jan-26 the lift station pump system must be repaired to a condition sufficient to prevent further discharges, or an additional citation and fine will be issued. By 09-Jan-26, a full inspection of the lift station by a licensed professional must be provided to BGPW to document the lift station is compliant; this inspection must include plumbing and electrical components. If the inspection shows further work needed, then that work must be completed within one week of the inspection.
BGPW staff will be inspecting this site regularly until compliance is reached. Any further discharges of sewage at this site will be cited as illicit discharges under City ordinance and fines issued. The bypass will remain in place until the lift station itself can handle the sewage flow. The property owner will be invoiced for costs incurred by the City in response to this incident, nonpayment may result in liens against the property.
