Code Description:
Other than naturally-occurring stormwater, no person shall discharge or cause to be discharged into the MS4, or any conveyance, any materials, including but not limited to pollutants or hazardous materials or waters containing any pollutants or hazardous materials that cause or contribute to a violation of applicable water quality standards. Allowable discharges that create or have the potential to create unsafe conditions on city streets or other public rights-of-way are prohibited. The commencement, conduct or continuance of any illegal discharge to the MS4 or any conveyance is prohibited. Sewage was observed discharging from a sewer cleanout at the northwestern end of the rear building. The sewage drained into the ground at the foundation of the building. A licensed plumber must inspect and make the necessary repairs to the system by Friday, November 21 2025. If the discharge has not been stopped by that date, an additional citation and fine will be issued.

Code Description:
Every person owning property through which a watercourse passes, or such person's lessee, shall keep and maintain that part of the watercourse within the property free of trash, debris, excessive vegetation and other obstacles that would pollute, contaminate or significantly retard the flow of water through the watercourse. In addition, the owner or lessee shall maintain existing structures within or adjacent to a watercourse so that such structures will not become a hazard to the use, function or physical integrity of the watercourse. The drainage swale along the property line with 1956 Stonehenge is not graded to convey stormwater to the basin at the rear of 1956 Stonehenge. It currently discharges to the wooded area on the state property behind the apartments through a scoured ditch. Per the record plat for the properties (book 28, page 73), the drainage easement for the swale along the side of the property ties into the one for Basin C at the rear of 1956 & 1960 Stonehenge. As the drainage swale is obstructed in places, scoured in others, and does not discharge to the basin, it is not draining as designed. This must be corrected by re-grading the swale to drain appropriately along its entire run into Basin C and repairing the scoured area. If corrective action has not begun by Friday, December 5 2025, a citation and fine will be issued for up to $1,000.
