Code Description:
No person shall own, keep or harbor any animal that unreasonably annoys humans, endangers the life or health of persons or other animals, or substantially interferes with the rights of citizens, other than their owner’s, to enjoyment of life or property. The term “animal nuisances” shall include, but is not limited to: Any animal that goes upon any property or premises not owned or occupied by the person who keeps, harbors or owns the animal without permission. Bowling Green police were dispatched out to a call about a dog trespassing on public roadways and properties not belonging to the owner. This resulted in multiple dog bites occurring in a short period and involved two separate victims. During our follow up investigation, it was confirmed to be the same cream-colored dog that was involved in the incident in April. This has generated multiple complaints to our office. Immediate action must be taken to ensure the dog is properly confined in order to avoid further action and/or fines.

Code Description:
No person shall own, keep or harbor any animal that unreasonably annoys humans, endangers the life or health of persons or other animals, or substantially interferes with the rights of citizens, other than their owner’s, to enjoyment of life or property. The term “animal nuisances” shall include, but is not limited to: Any animal that runs at, jumps upon, chases, barks at, bites at or in any other way frightens, molests or scares any person other than the one who owns, keeps or harbors the animal and the members of his/her immediate family. We have received multiple complaints about the dogs at this property frightening people in the neighborhood. This includes chasing kids to and from the bus stop, as well as people walking, running or riding bikes past the property. It has resulted in 3 confirmed and reported dog bite incidents and is becoming a significant safety risk to the community.

Code Description:
No person shall allow any animal they own, harbor or keep to bite any person on any premises owned or occupied by another person. If any animal should bite any other person besides the person who keeps, harbors or owns the animal, the owner, keeper or harborer shall be deemed to have violated this Section and the animal may be immediately subject to impoundment and/or quarantine. Bite incidents occurred and were reported on 4/9/25, 7/18/25, and 7/20/25. All of these bites involved the cream-colored dog living at this property and occurred on the public right of way in front of the neighboring houses.

Code Description:
It shall be unlawful for any person to keep, own or harbor, or allow to be kept on his/her property, any vicious or dangerous animal, as defined. “Vicious or dangerous animal” shall mean any animal that attacks, bites or physically injures human beings, domestic animals or livestock without adequate provocation. Any animal that without provocation has attacked a human being or other animal shall be presumed vicious or dangerous for purposes of this Chapter. All of the bite incidents that occurred were unprovoked and therefore meet the definition of harboring a vicious or dangerous animal. This dog should be handled and treated accordingly as it poses a significant safety risk to the public. Immediate action must be taken to ensure the dog is properly confined in order to avoid further action and/or fines.

BGKY C5 5-1.15.b Vicious or Dangerous Animals Enclosures
Code Description:
It shall be unlawful for any person to keep, own or harbor, or allow to be kept on his/her property, any vicious or dangerous animal, as defined hereinabove, except as follows: Such person shall keep such animal securely confined indoors or in an enclosure securely fenced so that the animal cannot escape therefrom, and is secured from entry by children or unintended persons. Any outdoor pen or structure must have minimum dimensions of five (5’) feet by ten (10’) feet and must have secure sides and a secure top. If it has no concrete, cement or asphalt bottom, the sides must be imbedded into the ground no less than two (2’) feet. The enclosure must also provide protection from the elements for the animal. A vicious or dangerous animal shall be transported to or from the indoors or to a securely enclosed outdoor pen or shelter only if such animal is muzzled and restrained by a suitable chain, leash or other means of appropriate restraint, which chain or leash is not more than six (6’) feet in length and a responsible adult capable of controlling the animal is in physical control of the chain or leash. All of the bite incidents that occurred were unprovoked and therefore meet the definition of harboring a vicious or dangerous animal. This dog should be handled and treated accordingly as it poses a significant safety risk to the public. Immediate action must be taken to ensure the dog is properly confined in order to avoid further action and/or fines.

BGKY C5 5-1.09.a Confinement (puppies and dogs)
Code Description:
Any owner, keeper or harborer of any animal shall confine such animal as defined.
Puppies and dogs: confinement shall mean on the premises of the owner and confined in a secure enclosure or accompanied by the owner on the owner's property and under his/her direct control. If off the premises of the owner, the animal must be restrained by a lead or leash and under the control of a responsible person, or accompanied by a responsible person into an approved off-leash area, and in conformance with all regulations and/or requirements imposed as a condition of utilizing such off-leash area. This dog must be confined to the property at all times by a proper enclosure that meets the standards for a vicious or dangerous animal. If the owner is present with the dog it must be on a leash, wearing a muzzle and under control.
