IPMC 3.302.7 Accessory structures General Requirements / Exterior Property Areas
All accessory structures, including detached garages, fences and walls, shall be maintained structurally sound and in good repair. The fence in this location is not maintained in good repair or sound condition. Fencing was constructed without required permits.
IPMC 3.308.1 Accumulation of Rubbish or Garbage General Requirements / Rubbish & Garbage
All exterior property and premises, and the interior of every structure, shall be free from any accumulation of rubbish or garbage. There is an accumulation of rubbish/garbage, junk, and debris outdoors on the property.
BGKY C27 27.4.03.a. a Unlicensed/Inoperable Motor Vehicle Property Code / Amendments to Property Maintenance Code / Motor Vehicles / Unlicensed/Inoperable Motor Vehicle
No junk motor vehicle shall be parked, kept or stored on any private premises longer than three (3) calendar days unless contained within an enclosed building. “Junk Motor Vehicle” is any inoperable motor vehicle, whether repairable or not, not displaying a current valid license plate, and/or which is wrecked, partially or totally dismantled, or cannot otherwise be safely or legally operated on a public roadway. There appears to be at least one unlicensed and/or inoperable vehicle on the premises. Please repair/remove any and all inoperable/unlicensed vehicles from the premises.
BGKY C27 27.5.03 Duty of Maintenance of Private Property Property Code / Nuisances
It shall be unlawful to place, leave, deposit or keep discarded and/or dilapidated items or objects, trash, garbage, junk and/or rubbish on any private property in the City. Such discarded and/or dilapidated items or objects, trash, garbage, junk and/or rubbish are declared to be a public nuisance. No person owning, leasing, occupying or having charge of any property or premises shall maintain or keep any nuisance thereon, nor shall any such person keep or maintain such property or premises in a manner which could cause a substantial reduction in the value of the other property in the area in which such property or premises are located. The exterior of the premises at this location is characterized by numerous code violations for an extended period of time. The exterior of the premises is not conducive to others in the surrounding area, and continues to generate multiple complaints from different complainants on an ongoing basis. Multiple attempts have been made to work with the property owner to bring the property into compliance without positive result.
BGKY C27 27.5.05.a Junk; Scrap Metal Property Code / Nuisances / Certain Conditions Declared a Nuisance
The storage of junk motor vehicles, motor vehicle parts, storage tanks, refuse/trash containers not being served by garbage collection franchisees, junk machinery, machinery parts, abandoned, discarded or unused appliances, objects neglected and not being used for their intended purpose, unused containers, objects or equipment in unusable condition such as stoves, refrigerators, washers, dryers and similar equipment, or scrap metal within the City limits, except on premises authorized by the City for such purposes; There is junk/scrap on the premises. This has generated numerous complaints to our office. Please remove any and all junk/scrap from the premises.
BGKY C27 27.5.05.b Accumulation of Construction, Demolition or Landscaping Debris Property Code / Nuisances / Certain Conditions Declared a Nuisance
All exterior property and premises shall be free from any accumulation of combustible and noncombustible waste materials, including any material resulting from maintenance, demolition, repair, alteration or construction of buildings, structures or grounds. Exterior property and premises shall be free from landscaping debris or natural damage of grounds, including but not limited to ashes, stones, glass, concrete, unused piles or bags of rock/mulch/soil, fallen trees, tree branches, limbs, brush and yard trimmings; There is an accumulation of landscape debris on the premises including, but not limited to, tree branches and/or limbs, construction material, lumber, junk, fencing, plywood, concrete, metal. This has generated numerous complaints to our office. Please remove any and all landscape debris from the premises.
BGKY C27 27.5.05.h Dilapidated Structures Property Code / Nuisances / Certain Conditions Declared a Nuisance
It shall be unlawful for the owner, occupant or person having control or management of any public or private land within the City to permit a public nuisance to develop thereon. Public nuisances include, but are not limited to, the following conditions: Dilapidated structures. All buildings, walls and other structures including, but not limited to greenhouses, smokehouses, antennas, retaining walls, mailboxes and fences, which have been damaged by fire, decay or otherwise and which are in a state of dilapidation, deterioration or decay so as not to provide shelter, sufficient sewer, plumbing, electrical or heating facilities or which are unsound or in danger of collapse or failure and which are a danger to the safety of the public or which are vacant or abandoned and open or accessible to vagrants or passersby or which are otherwise built, erected or maintained in violation of any ordinance. The fence on the premises (all or a portion thereof) does not appear to be structurally sound and/or maintained in good repair.
BGKY C27 27.5.05.o Parking in yards
The parking or storage or allowing another to park or store a motor vehicle in the front, side or rear yard of any property upon any surface other than an improved parking surface. “Improved Parking Surface” shall mean any existing gravel, contiguous area of pavers, concrete or asphalt surface generally used for parking motor vehicles. Such surfaces shall be maintained in good and safe condition, capable of performing the intended use, and give the visual appearance of a location for parking motor vehicles. There is at least one improperly parked vehicle in violation of code at this location. This has generated complaints to our office. Please ensure all vehicles at this location park on an improved parking surface as defined below.
