IPMC 110.4 Emergency Repairs
Code Description:
For the purposes of this section, the code official shall employ the necessary labor and materials to perform the required work as expeditiously as possible. The plumbing system at this location is extremely hazardous to the occupants and general public. Raw sewage has been allowed to leak in large volume into the soil, up to the surface, pooled on the surface, and flowing freely on the surface downhill. The property owner added tubes and pieces of metal in an effort to route the flow of sewage from the building downhill and into a nearby sinkhole and groundwater/cave system. The code official required immediate correction of the hazards as they are extremely dangerous to the health and safety of occupants, the public, and adjacent waterways. BGMU and a city contractor responded to the scene along with multiple city and state agencies, who stabilized the sewage leak, installed a temporary septic tank, and removed contaminated soil. A vacuum truck was used to remove as much accumulated sewage and gray water as possible. All emergency repairs were necessary for the health and safety of residents and the public.

Code Description:
Costs incurred in the performance of emergency work shall be paid by the jurisdiction. The legal counsel of the jurisdiction shall institute appropriate action against the owner of the premises where the unsafe structure is or was located for the recovery of such costs. Emergency repairs were performed by BGMU and a city contractor. All costs shall be borne by the property owner after emergency measures are complete.

The owner of the property is not properly maintaining plumbing facilities as required, and is allowing others to occupy a premises which is not being properly maintained. A very large amount of raw sewage is, and has been for some time, flowing out of the property and into open space where tenants and children are present. The raw sewage is flowing downhill onto the property of another, and into a cave system ultimately ending up in the creek.

It shall be unlawful to place, leave, deposit or keep discarded and/or dilapidated items or objects, trash, garbage, junk and/or rubbish on any private property in the City. Code Description:
The allowing of any physical condition, use or occupancy of any property or premises to be an attractive nuisance to children, or for illicit purposes, crime, drugs and/or vagrancy, including, but not limited to abandoned buildings, vacant lots, wells, shafts, standing pools of water, sinkholes, basements, excavations, retaining walls, and unsafe fences. Refrigerators, freezers, ice chests, ice boxes or any similar airtight box or container at an outdoor location which has a locking device inoperable from within, shall first unhinge and remove the door or lid and detach the locking device from the door or lid. Refrigerators, freezers, ice chests, or ice boxes in use at an outdoor location shall be equipped with an exterior locking device to prevent unintended access; A large open trench was dug by the property owner along a portion of the property which is a falling hazard for the many residents of adjacent apartments. Additionally, standing pools of raw sewage present an immediate health and safety hazard for all persons in the surrounding area.
