IPMC 3.302.7 Accessory structures General Requirements / Exterior Property Areas
All accessory structures, including detached garages, fences and walls, shall be maintained structurally sound and in good repair. The fence on the premises (all or a portion thereof) does not appear to be structurally sound and/or maintained in good repair. There are sections that are made from scrap that do not match the rest of the fence.
IPMC 3.304.2 Protective Treatment General Requirements / Exterior Structure
The exterior of a structure shall be maintained in good repair, structurally sound and sanitary so as not to pose a threat to the public health, safety or welfare. All exterior surfaces, including but not limited to, doors, door and window frames, cornices, porches, trim, balconies, decks and fences, shall be maintained in good condition. Exterior wood surfaces, other than decay-resistant woods, shall be protected from the elements and decay by painting or other protective covering or treatment. Peeling, flaking and chipped paint shall be eliminated and surfaces repainted. All siding and masonry joints, as well as those between the building envelope and the perimeter of windows, doors and skylights, shall be maintained weather resistant and water tight. All metal surfaces subject to rust or corrosion shall be coated to inhibit such rust and corrosion, and all surfaces with rust or corrosion shall be stabilized and coated to inhibit future rust and corrosion. Oxidation stains shall be removed from exterior surfaces. Surfaces designed for stabilization by oxidation are exempt from this requirement. There are areas of a structure at this location that lacks and/or has insufficient protective treatment including, but not limited to, areas of peeling/flaking/chipping paint as well as areas of missing or damaged siding. The outbuilding should be painted or covered in siding. There is missing soffit on the front of the house.
IPMC 3.304.7 Roofs and Drainage General Requirements / Exterior Structure
The exterior of a structure shall be maintained in good repair, structurally sound and sanitary so as not to pose a threat to the public health, safety or welfare. The roof and flashing shall be sound, tight and not have defects that admit rain. Roof drainage shall be adequate to prevent dampness or deterioration in the walls or interior portion of the structure. Roof drains, gutters and downspouts shall be maintained in good repair and free from obstructions. Roof water shall not be discharged in a manner that creates a public nuisance. Roof drains, gutters or downspouts on a structure at this location do not appear to be free of obstructions as there is foliage growing out of them. Please repair, replace or remove.
IPMC 3.304.10 Stairways, Decks, Porches & Balconies General Requirements / Exterior Structure
The exterior of a structure shall be maintained in good repair, structurally sound and sanitary so as not to pose a threat to the public health, safety or welfare. Every exterior stairway, deck, porch and balcony, and all appurtenances attached thereto, shall be maintained structurally sound, in good repair, with proper anchorage and capable of supporting the imposed loads. The stairs at the back door of the location are made of stacked bricks and do not appear to be stable.
IPMC 3.301.3 Vacant Structures and Land General Requirements / General
All vacant structures and premises thereof or vacant land shall be maintained in a clean, safe, secure and sanitary condition as provided herein so as not to cause a blighting problem or adversely affect the public health or safety. The property is vacant and is not being properly maintained in a safe, secure and sanitary condition. The exterior of the house is also showing signs of deterioration and has structural violations.
BGKY C27 27.5.03 Duty of Maintenance of Private Property Property Code / Nuisances
It shall be unlawful to place, leave, deposit or keep discarded and/or dilapidated items or objects, trash, garbage, junk and/or rubbish on any private property in the City. Such discarded and/or dilapidated items or objects, trash, garbage, junk and/or rubbish are declared to be a public nuisance. No person owning, leasing, occupying or having charge of any property or premises shall maintain or keep any nuisance thereon, nor shall any such person keep or maintain such property or premises in a manner which could cause a substantial reduction in the value of the other property in the area in which such property or premises are located. There are several code violations at this property both structural and non- structural. There have been several attempts to contact the owner, all of which have been unsuccessful.
BGKY C27 27.5.05.b Accumulation of Construction, Demolition or Landscaping Debris Property Code / Nuisances / Certain Conditions Declared a Nuisance
All exterior property and premises shall be free from any accumulation of combustible and noncombustible waste materials, including any material resulting from maintenance, demolition, repair, alteration or construction of buildings, structures or grounds. Exterior property and premises shall be free from landscaping debris or natural damage of grounds, including but not limited to ashes, stones, glass, concrete, unused piles or bags of rock/mulch/soil, fallen trees, tree branches, limbs, brush and yard trimmings; There is an accumulation of construction/demolition and/or landscape debris on the premises including, but not limited to, concrete blocks and bricks. Please remove any and all construction/demolition/landscape debris.
BGKY C27 27.5.05.r Abandoned Structures Property Code / Nuisances / Certain Conditions Declared a Nuisance
“Abandoned” shall mean any structure that is vacant, unoccupied or not in use for a period of one (1) year or more and which is any of the following: neglected, dilapidated, unsanitary, vermin infested, not serviced by public utilities, dangerous to the safety of person, unfit for its intended use by reason of neglect or lack of maintenance, has become a place for the accumulation of trash or debris or is the subject of a building permit requirement and has not satisfactorily passed building inspection in the last six (6) months or more. It shall be unlawful for the owner, occupant or person having control or management of any public or private land within the City to permit a public nuisance to develop thereon. Public nuisances include, but are not limited to, the following conditions: Abandoned Structures. It shall be unlawful to allow any building or structure to become abandoned. According to BGMU, this property has not had service since 02/22/2021.
BGKY C27 27.5.05.h.1 Dilapidated fences and walls
All fences and walls shall be structurally sound and maintained in good repair. Repair of fences and walls shall be made with materials that are comparable in composition, color, size, shape, design and quality to those originally used to construct the fence or wall being repaired. Materials for new fence or wall construction shall be insect and/or weather resistant or have protective treatment applied. Materials such as pallets, slabs, reclaimed or repurposed construction refuse, or similar materials are not an acceptable construction material; The fence on the premises (all or a portion thereof) does not appear to be structurally sound and/or maintained in good repair.
