BGKY C21 21.2.03.d Requirement to adhere to the COBG BMP Manual Public Infrastructure, Rights-of-Way and Stormwater / Stormwater Quality / Construction Site Stormwater Management
Code Description:
Requirements for the design, maintenance, and a menu of Best Management Practices (BMPs) are located in the City of Bowling Green Stormwater BMP Manual. Site construction in the City shall comply with the provisions of the BMP Manual. 1. A follow up Citation inspection will be conducted on 6/2/25 at noon expecting the following to be addressed:
• BMP’s installed for the majority of the site where it is needed (it is suggested that you install silt fence in high water flow areas and straw waddles for low water flow areas and rock checks for Major water flow areas)
• Straw waddles thrown on the hill behind the first building by the fire department needs removed. They have no functionality or purpose being there
• All existing rock checks need to be reevaluated and some remediated to appropriate function
• Current Silt fence by the office is not extended properly which in turn, has water rutting and traveling around the silt fence and over the roadway directly into the basin
• Old silt fence needs to be removed in areas where the vegetation has grown up and it is no longer needed (the developer is responsible for updating BMP’s and removing those not needed anymore)
• Drains need new protection since some are missing and most of the fabric installed in the others have fallen down with the amount of water flow going into them, therefore negating the purpose for the use
• Some trash and construction debris is not contained and needs to be cleaned up
• Exposed water main at the barrier wall is being covered by utilities but the barrier wall needs reconfigured and repaired properly so the washout does not continue. The functionality of the barrier wall is not correct.
• Both sinkholes need addressed as soon as possible due to the nature of them. They need proper barriers placed around them for safety concerns and one is growing towards the back porch of Building 3 which makes it a high concern for safety of the residents living there
• All areas that have bare soil needs to be stabilized. This is why you are having silt run off issues
2. The next compliance date will be on 6/16/25 at noon to check for the remaining items to be addressed:
• Sinkholes need repair. The one behind Building #6 needs a complete and detailed repair (Engineer assistance needed) due to the nature of the sinkhole. This one is affecting the capacity of the drainage for the basin. The sinkhole behind building #3, needs remedial repairs but it is suggested to reinforce it better since there has been fallout before.
• Fallen tree needs to be removed from basin by Cumberland Trace Rd. (Behind the Construction office trailer)
• Buildings that have had prior approval for a permit still are not EPSC compliant. They need grade clean up and stabilization (rutting and pop up spouts also needs to be repaired or replaced)
• All areas with rutting needs to be graded and stabilized on the entire development

Code Description:
Requirement to prevent, control and reduce stormwater pollutants by the use of BMPs. The City shall review and approve BMPs for any activity, operation or facility that may cause or contribute to pollution, discharge of hazardous materials or has the potential to contaminate naturally occurring stormwater or waters of the United States. The owner or operator of a commercial or industrial establishment shall provide, at their own expense, reasonable protection from accidental discharge of prohibited materials or other wastes into the MS4 or any conveyance through the use of these structural and non-structural BMPs. Further, any person responsible for a property or premise which is, or may be, the source of an illicit discharge may be required to implement, at such person's expense, additional structural and nonstructural BMPs to prevent the further discharge of pollutants or hazardous materials to the MS4 or any conveyance. BGKY C21 21.2.04.k Failure to protect a watercourse Public Infrastructure, Rights-of-Way and Stormwater / Stormwater Quality / Illicit Discharge; Applicability; Responsibility
Code Description:
Every person owning property through which a watercourse passes, or such person's lessee, shall keep and maintain that part of the watercourse within the property free of trash, debris, excessive vegetation and other obstacles that would pollute, contaminate or significantly retard the flow of water through the watercourse. In addition, the owner or lessee shall maintain existing structures within or adjacent to a watercourse so that such structures will not become a hazard to the use, function or physical integrity of the watercourse. 1. New infrastructure or alterations of existing infrastructure must meet specifications set forth in the City-County Planning Commission Subdivision Regulations, City of Bowling Green Stormwater BMP Manual, Kentucky Transportation Cabinet (KYTC) Specifications for Road and Bridge Construction, current edition, or other local, regional or national standards or regulations as determined by the Public Works Director or designee.
