Code Description:
1.) ZO Article 5, Section 5.1 – Use Table – The operation of a Short-Term Rental (Airbnb) business is prohibited in a Single Family Residential (RS1) zoning district. 2.) ZO Article 5, Section 5.1 – Use Table – The operation of a Short-Term Rental (Airbnb) business requires a Conditional Use Permit (CUP). 3.) ZO Article 5.2.4, Section C.4.c – Commercial Use Categories – Overnight Accommodations – Specific Use Standard - Short-Term Rentals – 1). Each room to be rented shall be designed and intended to accommodate no more than two persons. 2). The use shall not adversely affect the uses permitted in the area and in the immediate neighborhood by excessive traffic generation, noise and light. 3). One off-street parking space shall be required for each quest room available for rent (except in the CB (Central Business) zone. All off-street parking areas shall adhere to the landscaping requirements in Section 4.6.8.D unless utilizing an existing driveway for a residential use. 4). The use shall be in compliance with all other applicable state and local laws, including the Barren River District Health Department, building codes, business registration and occupational licensing requirements. 5). Short-term rental uses do not allow commercial uses such as meetings, seminars, tea/garden parties, weddings, receptions, or concerts unless such uses are permitted by right in the underlying zoning district in which the short-term rental use is located. 6). A short-term rental license must be issued by the Planning Commission office prior to operating such use. If listed for rent on an online platform, the license number must be displayed in the listing.
