BGKY C21 21.1.04 No Construction Materials or Debris on Street. Public Infrastructure, Rights-of-Way and Stormwater / General Provisions

Code Description:
It shall be a civil violation for any person to track or leave upon any city street, alley or sidewalk any construction materials or debris so as to obstruct or impede traffic or cause property damage or personal injury. Additionally, any person performing work at a construction site on or near any street, alley or sidewalk shall comply with the standards of the current edition of the Manual on Uniform Traffic Control Devices (MUTCD) and with right-of-way work permit requirements. Mud, including large clods and gravel, has been tracked onto Cedar Run Street for several hundred feet; mud was observed in the grates of stormwater inlets on this street. The area outside the entrance onto White Dogwood Drive has tracking of mud with clods and gravel, as well. Staining was also observed (without large clods or gravel) on Turkey Run Drive, Cedar Hollow Drive, and China Tree Way. Follow-up inspections at the affected streets on May 19 and May 22 showed that the corrected actions had not been completed. The affected streets and grates should be cleaned immediately. A re-inspection has been scheduled for Friday, June 5th, 2020. If at such time these issues have not been resolved, additional citations and fines will be issued.

Code Description:
Requirements for the design, maintenance, and a menu of Best Management Practices (BMPs) are located in the City of Bowling Green Stormwater BMP Manual. Site construction in the City shall comply with the provisions of the BMP Manual. Construction entrances onto Cedar Run Street, Turkey Run Drive, Cedar Hollow Drive, White Dogwood Drive, and China Tree Way have not been effective at minimizing tracking of mud into residential streets. Sediment has built up on the gravel at the entrances and is being tracked into residential streets along with the gravel. The entrances should be reworked to cover or remove accumulated sediment, and maintained regularly to prevent recurrence. Entrances that are undersized (less than 100', per the approved plans) must be expanded. Follow-up inspections at the affected streets on May 19 and May 22 showed that the corrected actions had not been completed. The affected streets and grates should be cleaned immediately, and the construction entrances must be brought into compliance into compliance. A re-inspection has been scheduled for Friday, June 5, 2020. If at such time mud is still present in the streets and the construction entrances have not been brought into compliance, further citations and fines will be issued.
