IPMC 3.304.2 Protective Treatment General Requirements / Exterior Structure
The exterior of a structure shall be maintained in good repair, structurally sound and sanitary so as not to pose a threat to the public health, safety or welfare. All exterior surfaces, including but not limited to, doors, door and window frames, cornices, porches, trim, balconies, decks and fences, shall be maintained in good condition. Exterior wood surfaces, other than decay-resistant woods, shall be protected from the elements and decay by painting or other protective covering or treatment. Peeling, flaking and chipped paint shall be eliminated and surfaces repainted. All siding and masonry joints, as well as those between the building envelope and the perimeter of windows, doors and skylights, shall be maintained weather resistant and water tight. All metal surfaces subject to rust or corrosion shall be coated to inhibit such rust and corrosion, and all surfaces with rust or corrosion shall be stabilized and coated to inhibit future rust and corrosion. Oxidation stains shall be removed from exterior surfaces. Surfaces designed for stabilization by oxidation are exempt from this requirement. There are areas of a structure at this location that lack and/or have insufficient protective treatment including, but not limited to, areas of significant peeling/flaking/chipping paint, windows/sills/frames in states of deterioration/decay, exposed and untreated wood in various states of deterioration and decay. This violation has been present for an extended period of time, and the owner has been given over 240 days to show any measurable improvement.
IPMC 3.304.6 Exterior Walls General Requirements / Exterior Structure
The exterior of a structure shall be maintained in good repair, structurally sound and sanitary so as not to pose a threat to the public health, safety or welfare. All exterior walls shall be free from holes, breaks, and loose or rotting materials; and maintained weatherproof and properly surface coated where required to prevent deterioration. There appear to be holes, cracks and/or breaks in exterior walls on the primary structure at this location.
IPMC 3.304.15 Doors General Requirements / Exterior Structure
The exterior of a structure shall be maintained in good repair, structurally sound and sanitary so as not to pose a threat to the public health, safety or welfare. All exterior doors, door assemblies and hardware shall be maintained in good condition. Locks at all entrances to dwelling units and sleeping units shall tightly secure the door. Locks on means of egress doors shall be in accordance with Section 702.3. At least one exterior door on a structure at this location is missing and/or not maintained in good repair. This includes, but is not limited to, a door with broken glass, structural damage to the door and has evidence of past forced entry. The owner is aware of the state of this door and an extended period of time to repair/replace it without any change.
IPMC 3.304.18.1 Doors General Requirements / Exterior Structure / Building Security
Doors providing access to a dwelling unit, rooming unit or housekeeping unit that is rented, leased or let shall be equipped with a deadbolt lock designed to be readily openable from the side from which egress is to be made without the need for keys, special knowledge or effort and shall have a lock throw of not less than 1 inch (25 mm). Such deadbolt locks shall be installed according to the manufacturer's specifications and maintained in good working order. For the purpose of this section, a sliding bolt shall not be considered an acceptable deadbolt lock. An exterior door at this location is not maintained in good repair or safe condition, show signs of forced entry and has broken windows/glass, and does not provide required security.
IPMC 3.304.13.1 Glazing General Requirements / Exterior Structure / Window, Skylight & Door Frames
The exterior of a structure shall be maintained in good repair, structurally sound and sanitary so as not to pose a threat to the public health, safety or welfare. Every window, skylight, door and frame shall be kept in sound condition, good repair and weather tight. All glazing materials shall be maintained free from cracks and holes. Windows, sills and frames are not maintained in good condition at this location and show signs of deterioration and decay. Additionally there are broken windows on an exterior door for an extended period of time and now a broken/missing window on the second story of the structure as well.
BGKY C27 27.6.03 Duty of Maintenance of Private Property Property Code / Nuisances
No person owning, leasing, occupying or having charge of any property or premises shall maintain or keep any nuisance thereon, nor shall any such person keep or maintain such property or premises in a manner which could cause substantial diminution in the value of the other property in the neighborhood in which such property or premises are located. The exterior of the structure at this location is in a state of disrepair and is in a manner which could cause diminution in the value of other property in the neighborhood in which it is located. Code violations have been present for an extended period of time and the property owner has been given over 240 days to show progress or improvement regarding these violations.
BGKY C27 27.6.05.a Junk; Scrap Metal Property Code / Nuisances / Certain Conditions Declared a Nuisance
It shall be unlawful for the owner, occupant or person having control or management of any public or private land within the City to permit a public nuisance to develop thereon. Public nuisances include, but are not limited to, the following conditions: Junk; scrap metal. The storage of junk motor vehicles, motor vehicle parts, storage tanks, dumpsters, refuse/trash containers not being served by the County’s garbage collection franchisees, junk machinery, machinery parts, abandoned, discarded or unused appliances, objects or equipment in unusable condition such as stoves, refrigerators, washers, dryers and similar equipment, or scrap metal (whether recyclable or unrecyclable) within the City limits, except on premises authorized by the City for such purposes; There is junk/scrap on the premises including, but not limited to, unused/discarded appliances. Please remove any and all junk/scrap from the premises.
