ZO Article 3, Section 3.2 Site Work Permit and Building Permit – It shall be unlawful to begin the construction of any structure or begin or change the use of a premises until the Building Inspector has issued a site work permit or building permit. A site work permit and building permit were not issued for the property before the existing parking area was constructed.

ZO Article 3, Section 3.15.1.C, Certificate of Appropriateness, When Required – A Certificate of Appropriateness from the Preservation Board shall be required before installing a new parking area in a local historic site, and/or local historic districts. A Certificate of Appropriateness is required from the Preservation Board for new parking areas. There was no Certificate of Appropriateness issued for the existing parking area located on the property. ZO Article 4, Section 4.9.4.H.3, Subsections b, c and d - Driveways and Parking Areas in the College Hill Local Historic District b. New parking areas are to be no larger than six spaces and are to be screened. The parking area contains 12 spaces and exceeds the maximum number of spaces permitted in the College Hill Local Historic District. c. Rear yards should not be significantly altered for parking. Existing topography and vegetation should be retained as much as possible. Prior to installation of the existing parking area, the rear yard contained grass, a walkway, several mature trees and was enclosed by a privacy fence. The rear yard was significantly altered to accommodate the existing parking area and does not comply with this section of the zoning ordinance. d. If parking is located in the rear yard, it is recommended that wood board fencing be installed to screen the parking. The parking area is not screened with wood board fencing as recommended by this section of the zoning ordinance.

ZO Article 3, Section 3.2.2, Subsections A and C – A building permit application may also include the following items if required by other Sections of this Ordinance: A. Landscape Plan (as applicable) - a scaled drawing, including dimensions and distances, existing and proposed buildings, vehicle use areas, driveways, and the location, size, and description of all landscape materials; and, C. Grading and or Drainage Plan (as applicable). A landscape plan and grading/drainage plan were not reviewed by the appropriate agencies prior to completing the grading/paving work for the existing parking area located on the property. ZO Article 4, Section 4.5.4.D, Landscaping – All multi-family residential development shall comply with the minimum landscaping standards as set forth in Section 4.6.8.D. The property does not comply with this section of the zoning ordinance (see below). ZO Article 4, Section 4.6.8.D.1, Subsections a and b: a. No new site, development, building, structure or vehicle use area (VUA) shall hereafter be constructed unless landscaping is provided as required by the zoning ordinance, regardless of the need for a building permit. b. No building, structure or VUA shall be expanded or moved unless the minimum landscaping is provided as required by the zoning ordinance. Landscaping was not installed on the property in conjunction with the construction of the existing VUA as required by this section of the zoning ordinance.
