1.) ZO Article 3, Section 3.19.5. – Agreement to Development Plan Conditions – The filing of an Overlay Development Plan shall constitute an agreement between the Planning Commission and the persons signing the application, their heirs, successors, personal representatives and assigns that: Building permits and site work permits for improvements of the property in question shall be applied for and issued only when in conformance with the approved Overlay Development Plan. The filing for a building permit or site work permit not in conformance with these provisions shall constitute a breach of agreement enforceable by the Planning Commission or appropriate legislative body. (Violation) – Condition of approval of ODP-07-2016 included submission of a revised landscaping plan for approval, prior to obtaining a building permit. A revised landscaping plan was not submitted for review and approval as required by this condition.

2.) ZO Article 3, Section 3.19.1. – Overlay Development Plan Required – Prior to the application for any building permits for new construction or exterior improvements within any Urban Growth Overlay District, an Overlay Development Plan shall be submitted for approval by the Design Review Board. In the case of an Overlay Development Plan application involving only the installation of a sing(s), Planning Commission staff may grant approval of such application as long as the proposed signage clearly complies with all sign requirements of the applicable Urban Growth Overlay District including height; square footage; materials, colors and shades of the proposed sign(s); and lighting/illumination. If compliance with any of these requirements cannot clearly be determined by staff, then such signage shall be reviewed and approved by the Design Review Board. (Violations) – The existing fence did not receive approval by the Design review Board and the existing canopy structure located in the play area did not receive approval by the Design Review Board and is located within the 30’ setback, utility, and drainage easement.

3.) ZO Article 4.6.8., Section D.5.C. – General Commercial Development Standards – Landscaping. All trash disposal units and ground level storage units shall be enclosed within walls, vegetation, or earthen berm on all sides with an opening door for the removal of trash or stored items. The height of the screening shall be 18 inches higher than the structure to be screened, but shall not be required to exceed eight feet in height. (Violation) – The existing trash disposal unit is located in the public right-of-way and is not screened in accordance with Zoning Ordinance requirements.
